Backyard Poultry Terms of Sale

These Terms of Sale apply to the purchase of backyard poultry from The Poodle and The Hen Pty Limited (ABN 50 656 062 752) through our website. They apply in addition to our general Terms of Service, Refund Policy, and Privacy Policy. By purchasing a bird from us, you agree to these terms, so please read them first.
1. Eligibility
You must be 18 or over to buy birds from us. Buyers must be Australian citizens or residents. Birds are for local pickup in New South Wales, or delivery within NSW where we've agreed to it.
2. Ordering and payment
Birds are released to our waitlist first and sold through our website while available. You can pay online when you order, or choose cash on pickup at checkout where offered. Feed and poultry supplies must be paid for online, in full, at the time of order.
3. Collection
Birds are collected in person from our designated pickup point in Bargo, NSW, not from our farm for biosecurity reasons. When you buy a bird, you agree to attend and collect in person at the meeting point and time we confirm with you. You're responsible for bringing a suitable, well-ventilated container to carry your birds home safely. If you need transport, contact us by email before you buy and we'll discuss options, including our occasional delivery runs within NSW.
4. If you don't collect your birds
We don't hold birds beyond the agreed collection period. If you don't attend your confirmed pickup:
(a) Cash on pickup orders: your birds are reserved on the basis that you attend. If you don't show and don't contact us to reschedule, we reserve the right to invoice you for the agreed price of the birds. You will also be removed from our poultry waitlist and won't be eligible to rejoin.
(b) Prepaid online orders: we'll offer you one further collection time, at a date, time and place of our choosing. If you can't attend that time, we reserve the right to retain your payment to cover our time and costs, though we may offer a refund at our discretion. You will also be removed from our poultry waitlist and won't be eligible to rejoin.
We understand things come up. If you let us know before your pickup that you can't make it, we'll do our best to work something out.
5. Health and welfare of birds (Disclaimer)
All birds are sold in a healthy state at the time of handover. Once the birds are transferred to the buyer, The Poodle and The Hen takes no responsibility for any injuries, illnesses, or deaths that may occur. A bird's health and wellbeing after collection depend on your care, housing, and handling, which are your responsibility. Nothing in this clause limits any rights you have under the Australian Consumer Law.
6. Unsexed birds
Day-old chicks are sold unsexed. We can't guarantee the sex of an unsexed bird, and some may turn out to be roosters. Please consider your circumstances, including any local council rules on roosters, before buying unsexed birds.
7. Appearance and quality
The birds we sell are backyard quality. Photos in our emails and on our website are examples to show the breed and age, and your birds won't look exactly the same. Natural variation between birds is normal. Where a bird has a cosmetic characteristic we're aware of, such as a bent toe, we'll tell you and price it accordingly before you buy.
8. Our waitlist
Membership of our poultry waitlist is free and at our discretion. We may remove anyone from the waitlist, including in the circumstances described in clause 4.
9. Your consumer rights
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms limits those rights. These terms apply in addition to them.
10. Governing law
These terms are governed by the laws of New South Wales, Australia.
